Welcome to Meridian Realms. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using Meridian Realms (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1.1 Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you meet this eligibility requirement. Users under the age of 18 are prohibited from using the Service. You may not use the Service if you are located in a jurisdiction where our Services are prohibited, or if you are on any applicable sanctions or restricted parties list.

1.2 Account Registration

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your account information as needed
• Accept responsibility for all activities under your account

2. Description of Service

Meridian Realms is an interactive storytelling platform that enables users to create, share, and explore AI-powered narratives and characters. Our Service includes:

• World Building: Create immersive settings and lore for your stories
• Character Creation: Design unique characters with detailed personalities
• Interactive Storytelling: Engage in dynamic conversations with AI-powered characters
• Image Generation: Generate rich images depicting your stories and characters
• Community Features: Share and discover curated content created by other users

2.1 AI-Generated Content

Our Service utilizes artificial intelligence to generate responses and content. You acknowledge that:

• AI-generated content may not always be accurate or appropriate
• We do not guarantee the quality or suitability of AI responses
• You are responsible for reviewing and moderating content in your experiences
• The Service is for entertainment purposes only. You should not rely on the Service for professional, medical, legal, or financial advice
• AI outputs may be unpredictable, may reflect biases, and may produce inaccurate or inappropriate results. You are responsible for your use of any outputs.

3. User Content

3.1 Your Content

You retain ownership of content you create on Meridian Realms. To operate and provide the Service, you grant us a worldwide, non-exclusive, royalty‑free, transferable, and sublicensable license to host, store, reproduce, perform, display, adapt, modify (for formatting and technical purposes), and create derivative works of your content solely as necessary to operate, maintain, secure, improve, and provide the Service and its features you choose to use (including AI transformations you request). This license applies to both public and private content you upload to the Service. We do not use your content to train foundation AI models unless you expressly opt in.

This license ends when you remove your content from the Service or delete your account, except that reasonable copies may persist in backups, logs, or where retention is required by law. For publicly shared content, the license continues for the time reasonably needed to remove it from caches and mirrors.

3.2 Content Guidelines

You agree not to create or share content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Violates the privacy of others
• Is deceptive or fraudulent
• Exploits or harms minors in any way
• Depicts minors or young‑looking persons in sexualized contexts, or sexualizes non‑consenting persons, whether real or simulated
• Attempts to bypass safety features or filters
• Doxxes, threatens, or incites harassment of individuals

3.3 Content Moderation

We reserve the right to review, remove, or disable access to any content that violates these Terms or our Community Guidelines, at our sole discretion and without prior notice. We may suspend or terminate accounts associated with egregious or repeated violations.

3.4 Copyright, Takedown, and Repeat Infringer Policy

We respect intellectual property rights and respond to notices of alleged infringement. If you believe content infringes your rights, please send a notice to copyright@meridianrealmsai.com with: (a) your contact information, (b) a description of the work and the allegedly infringing content (URL/ID), (c) a statement of good‑faith belief that use is not authorized, and (d) a statement under penalty of perjury that the information is accurate and you are the rights holder or authorized to act. We may remove or disable content and, where appropriate, terminate repeat infringers. If your content was removed in error, you may submit a counter‑notice.

4. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in that policy.

4.1 Data You Provide

We collect information you provide directly, including:

• Account Information: Email address, display name
• Profile Information: Chosen user identity names and profiles
• Content: Characters, worlds, stories, and other creative content you create
• Communications: Messages you send to our support team, staff, or other users

4.2 Automatically Collected Data

We automatically collect certain information when you use the Service, including:

• Device Information: Browser type, operating system, device identifiers
• Usage Data: Pages visited, features used, time spent, and interaction patterns
• Log Data: IP addresses, access times, and referring URLs
• Cookies and Similar Technologies: Session data and preferences
• Payment and Subscription Data: Tokenized IDs, transaction metadata, and subscription data.

Your use of third‑party services linked from the Service (e.g., Discord) is subject to their own terms and privacy policies.

5. Intellectual Property

5.1 Our Rights

The Service, including its design, features, and content (excluding user-generated content), is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

5.2 Trademarks

"Meridian Realms" and associated logos are our trademarks. You may not use these marks without our prior written consent.

5.3 Feedback

If you send us ideas, suggestions, or proposals, you grant us a perpetual, worldwide, irrevocable, royalty‑free license to use and exploit them without restriction or compensation.

6. Fees, Subscriptions, and Trials

6.1 Billing and Auto‑Renewal

Some features are paid. If you purchase a subscription, you authorize us (and our payment processors) to charge your payment method the recurring fees disclosed at checkout until you cancel. We will disclose the renewal frequency, price, and how to cancel in a clear and conspicuous manner at signup.

6.2 Cancellation

You can cancel at any time via account settings; cancellation takes effect at the end of the current billing period unless otherwise stated. You will continue to have access until then.

6.3 Free Trials and Promotions

If you start a trial, you will be charged at the end of the trial unless you cancel before it ends. We will disclose trial length and post‑trial pricing at signup.

6.4 Price Changes

We may change prices prospectively with at least 30 days’ notice for recurring plans. Continued use after the effective date constitutes acceptance. If you do not agree, cancel before the change takes effect.

6.5 Refunds

Unless required by law, fees are non‑refundable and non‑creditable once charged (including for partial periods), except where we expressly state otherwise.

6.6 Taxes

Fees are exclusive of taxes. You are responsible for any applicable taxes, duties, or charges, except those based on our net income.

6.7 Failed Payments and Chargebacks

If a payment fails or is disputed, we may suspend access until the issue is resolved. Unfounded chargebacks may result in account termination.

7. Prohibited Activities and Content

7.1 You agree not to:

1. Use the Service for any unlawful purpose
2. Attempt to gain unauthorized access to the Service or related systems
3. Interfere with or disrupt the Service or servers
4. Use automated systems to access the Service without permission
5. Impersonate any person or entity
6. Collect personal information about other users
7. Engage in any activity that could harm the Service or its users

7.2 You must not attempt to generate content that includes:

1. Illegal Acts: Content promoting illegal acts, terrorism, or violence.
2. CSAM: Child Sexual Abuse Material or any content depicting minors in a sexualized manner.
3. Non-Consensual: Content depicting sexual violence or non-consensual sexual acts.
4. Hate Speech: Content that promotes hatred or harassment based on race, ethnicity, religion, disability, gender, or sexual orientation.
5. Deepfakes and Impersonation: Content that creates, generates, or distributes deepfake images or videos intended to deceive, defraud, or misrepresent real individuals without their consent, including realistic depictions of identifiable persons in fabricated scenarios—particularly sexual, violent, defamatory, or otherwise harmful.
6. Circumvention: Attempting to bypass safety features, access controls, rate limits, or usage quotas; probing or scanning systems without authorization.
7. Scraping and Automated Access: Scraping the Service, bulk exporting content, or using bots not expressly permitted by us.
8. Reverse Engineering: Reverse engineering or attempting to extract source code, models, or datasets except to the limited extent permitted by applicable law.

8. Restricted Content & User Controls

The Service is a creative writing and interactive fiction tool for adults (18+). Some features may permit mature themes found in fiction intended for adults.

1. Optional and Revocable: Restricted Content settings are disabled by default and are available only to users with an active paid subscription. Enabling these settings is voluntary and requires an explicit opt‑in (and 18+ affirmation) in Settings; you can disable them at any time. By enabling them, you give your explicit consent to the processing of related content as described in our Privacy Policy.
2. Fictional Context: Any mature material is synthetic and provided for storytelling, character development, and world‑building (“Fictional Content”). Outputs may be unpredictable; you are responsible for how you use them.
3. Age and Consent: Restricted Content settings permit only consensual fiction involving persons 18+ (or higher if required by local law). Content depicting or role‑playing minors or young‑looking persons is prohibited, even if described as “aged up.”
4. Prohibited Content Remains Prohibited: The Service does not permit (and will filter) content depicting sexual violence or non‑consensual acts; incest; bestiality; exploitation or trafficking; Child Sexual Abuse Material (CSAM); or sexualized depictions of real, identifiable persons without their consent (including deepfakes). Attempts to bypass or defeat safety measures are a violation of these Terms and may result in immediate suspension or termination and, where required by law, reporting to relevant authorities.
5. Moderation & Safety: We use automated and human review to enforce these rules and may adjust or restrict features to maintain safety and legal compliance. Restricted content is not displayed on public‑facing surfaces of the Service.
6. Regional Restrictions: Access to Restricted Content settings may be unavailable in certain jurisdictions, and we may geofence or disable these features where required by law or by our payment/service providers.
7. Reporting: You can report content or behaviour that violates these Terms. We may remove content and take action on accounts that violate this section or our Community Guidelines.

9. Termination

9.1 By You

You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service will cease immediately.

9.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in prohibited activities, or for any other reason at our discretion. We may also discontinue the Service at any time.

9.3 Effect of Termination

Upon termination:

• Your license to use the Service ends immediately
• We may delete your account data and content
• Provisions that should survive termination will remain in effect
• Prepaid fees are not refunded unless required by law or expressly stated otherwise
• We may retain and use information as necessary to comply with our legal obligations, resolve disputes, and enforce these Terms
• Residual copies of your content may persist in encrypted backups for a limited retention period

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NOTHING IN THESE TERMS EXCLUDES, RESTRICTS, OR MODIFIES ANY RIGHT OR REMEDY, OR ANY GUARANTEE, WARRANTY, OR OTHER CONDITION IMPLIED OR IMPOSED BY THE AUSTRALIAN CONSUMER LAW (ACL) OR OTHER APPLICABLE LAW THAT CANNOT BE LAWFULLY EXCLUDED. SUBJECT TO THE FOREGOING, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Merchantability: No guarantee that the Service meets your requirements
• Fitness for Purpose: No guarantee of suitability for any particular use
• Non-Infringement: No guarantee that the Service doesn't infringe third-party rights
• Availability: No guarantee of uninterrupted or error-free operation

Where the ACL applies and liability for breach of a non‑excludable guarantee can be limited, our liability is limited (at our option) to supplying the services again or paying the cost of having the services supplied again.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Any other intangible losses

Subject to non‑excludable rights under applicable law, our total aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid to us for the Service in the twelve (12) months before the event giving rise to liability, or (b) AUD $100. These limits do not apply to liability that cannot be limited by law.

12. Indemnification

You agree to indemnify and hold harmless Meridian Realms, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or activities on the Service

13. Export Controls and Sanctions

You may not use the Service if you are located in, or a resident of, a country or territory subject to comprehensive sanctions, or if you are on any sanctions/restricted parties list. You agree to comply with all applicable export control and sanctions laws.

14. Governing Law and Venue

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of laws rules. The courts of Victoria have exclusive jurisdiction, except that consumers outside Australia may also bring claims in the courts of their country of residence where required by law. Mandatory consumer protections in your country of residence remain unaffected.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the new Terms on this page
• Updating the "Last Updated" date
• Sending you an email notification (for significant changes)

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. For material changes to recurring billing terms, we will provide advance notice as required by law.

The Service may link to or interoperate with third‑party services (e.g., Discord). We are not responsible for those services, which are governed by their own terms and privacy policies.

19.1 Entire Agreement; Interpretation

These Terms, together with any policies or guidelines incorporated by reference (including the Privacy Policy and Community Guidelines), are the entire agreement between you and us regarding the Service and supersede all prior agreements. Headings are for convenience only. The words “including,” “such as,” and similar terms are illustrative and not limiting.

19.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

19.5 Survival

Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, payment obligations accrued, and dispute resolution) survive termination.
